Those who want to explore this PPP modality ask these 10 questions:

         1. Is there one law or policy which governs lease contracts where Government Agencies are the lessors?

         2. If there is more than one law or policy, what are the governing laws, guidelines and regulations on PPP-Leases?

         3. Does the governing policy vary if the Government Agency is the lessor or lessee?

         4. Is a Build-Lease-and-Transfer (BLT) arrangement the same as a straight/ simple lease, and therefore the
applicable law for the latter scheme is the BOT Law?

         5. When are the Government Procurement Reform Act, BOT Law, Public Land Act and DPWH Guidelines relevant?

         6. Can Government Agencies adopt their own Lease Guidelines?

         7. Why choose lease over other PPP modalities?
